1. The Criminal Information describing Perry Belcher’s crimes.

2. Perry’s guilty plea and the court order for it.

3. Belcher’s probation order and the special conditions placed on his probation.

To protect Belcher’s privacy, I redacted his street address and telephone number. Otherwise, the documents are intact.

I will not comment on the criminal records as an Internet attorney or otherwise. You can decide for yourself what happened and whether or not Perry Belcher has complied with the terms of his probation.

However,  a final thought…and a warning.

Perry Belcher’s “partner” reached out to a group of major Internet marketers asking for help to shut me (and others) up on this issue.  Pressure was applied by certain group members (who may have been acting on their own) to encourage termination of representation by me as Internet attorney for certain clients or to engage in unethical conduct that would trap me into silence.

I will continue to zealously represent those members who are existing clients as their Internet attorney if they want but I will not be silenced by threats to my personal safety or my law practice because of Perry Belcher or any other reason.

Please note that the last person who tried this type of intimidation was indicted by the U.S. federal government, now has a criminal record, and owes the IRS about $750,000 in back taxes. If the personal threats and business interference continues, expect a similar response. Picking a fight with an Internet attorney borders on business suicide.

Unsubscribe: How To Simplify Your Internet Life

unsubscribeOverwhelmed by e-newsletters, tweets, rss feeds, status updates and instant messaging?

Unsubscribe.

What?!!! You can’t be serious.

Absolutely. There’s no Internet law preventing you from doing it (despite what the hidden continuity Internet marketing guys say).

Rank every e-newsletter, blog rss feed, social media/social networking subscription you’ve got one-by-one…then trash 90% of them.

How?

Let’s start with your e-newsletter subscriptions. Rank them in order of importance to your life (what you actually read as opposed to should read). If you’ve got 20 subscriptions, unsubscribe from newsletters ranked #3 through #20 (that’s 9/10 i.e. 90%).

Move to Twitter. Rank those you’re following and then unfollow 90%.

RSS Feeds – rank and unsubscribe.

Facebook – rank and block/defriend.

Lather, rinse, repeat.

Then put a tickler in your calendar to remind you every 30 days to repeat this exercise.

The sun will rise tomorrow, you’ll feel less overwhelmed by “should do” and information overload.

Who knows? Maybe in a month you’ll be ready to go unwired 1 or 2 days per week.

Yes, there is a life outside of cyberspace. Try it.

Buy-Sell Agreements: How to Get Rid of Your Partners

business-partners-fightingAll business relationships end. A few when one of the parties is buried six feet under. Most end for other reasons: an owner’s divorce, bankruptcy, personality conflicts, etc. The list goes on. Yet one thing is clear: most Internet entrepreneurs have done absolutely nothing in advance to prepare for the inevitable.

One of the easiest preventative measures that e-commerce company owners can do is enter into a buy-sell agreement that provides for the buyout of other each other under certain conditions (like the ones listed above). Similar to a pre-nuptial agreement, a buy-sell agreement can be structured so that everyone wins in the future when the relationship terminates. There’s no better time to put such a contract in place than when all shareholders, members, partners, etc. are getting along instead of fighting. A mutual interest in protecting the company exists and no one is looking to punish another at that time.

Unfortunately, most online entrepreneurs wait until it is too late. Instead of resolving their differences and parting ways based upon specific terms in a buy-sell agreement, they try to figure out how to escape what is now a bad deal with maximum gain and sometimes with maximum pain inflicted on the other side.

If you own an e-commerce company with others, talk with them about having your Internet business lawyer draft a solid buy-sell agreement so that you can reduce the risk of destroying your business in the future.
