			<content:encoded><![CDATA[<p>Like photos, sales copy, order buttons, etc., chances are your logo will either be ripped off by someone or you&#8217;ll get a claim one day that you stole someone else&#8217;s logo.</p>
<p>Copying it is one thing. The gray area is where substantive changes have been made. On the funny side, Dogbert in the <a href="http://dilbert.com/"title="dilbert comic cartoon" target="_blank"  onclick="javascript:urchinTracker ('/outbound/article/dilbert.com');">Dilbert comic strip</a> designed a logo that supposedly was the &#8220;circle of quality&#8221;&#8230;which happened to look like the stain your coffee mug would make if placed on a sheet of white paper. A couple years later, Lucent came out with a logo that looked like the coffee mug stain. Wonder if the designer reads Dilbert.</p>
<div align="left">There are only a finite number of shapes, letters, and colors to work with when creating a logo.</div>

<div align="left">It probably resembles a couple of things you routinely see&#8230;and there&#8217;s even been a few kooks who have claimed the logo represents my membership in some type of world domination conspiracy.</div>

<div align="left">If you think that your trademark or service mark has been infringed upon, talk to your intellectual property lawyer about it to see what, if anything, can be done about it. Don&#8217;t get into an &#8220;I&#8217;m going to sue you&#8221; flame war with the person who &#8216;borrowed&#8217; your mark. Find out what your legal rights are and then pursue them.</div>

			<content:encoded><![CDATA[<p>The moonbats at <a href="http://moveon.org/"title="moveon moonbats traitors" target="_blank"  onclick="javascript:urchinTracker ('/outbound/article/moveon.org');">MoveOn.org</a> support free speech only if it is a discounted full page ad in the New York Times where they smear a <a href="http://en.wikipedia.org/wiki/David_Petraeus"title="general david petraeus" target="_blank"  onclick="javascript:urchinTracker ('/outbound/article/en.wikipedia.org');">U.S. general</a> as being a traitor.</p>
<p>Overreaching with the smear, there has been grassroots opposition to it from all parts of the political spectrum&#8230;including entrepreneurs who have created t-shirts in protest of the McCarthyesque tactics applied by MoveOn.org to attack anyone who doesn&#8217;t agree with the organization completely.</p>
<p>In response to trademark infringement claims made by the moonbats, Cafe Press has pulled t-shirts from inventory that make reference to MoveOn.org by name. This is a unique interpretation of trademark law&#8230;mentioning an organization&#8217;s name in satirical political works is a violation? Hardly.</p>
<p>But the moonbats insist that you and I don&#8217;t have First Amendment rights to dissent. Like Lord Voldemort (he who must not be named), the MoveOn.org doesn&#8217;t want to be mentioned.<br />
Just because someone claims trademark infringement, don&#8217;t take the claim at face value. Check with your lawyer.</p>
<p>And as for MoveOn.org, here&#8217;s one of the censored messages.</p>

			<content:encoded><![CDATA[<p>American Airlines is suing Google, claiming trademark infringement because competitors are purchasing AA&#8217;s trademarks as keywords to drive traffic to their sites. These type of suits are common, a cost of doing business for Google. But the issue will remain unresolved as long as the courts are split as to whether the practice of using trademarks as keywords constitutes infringement.</p>
<p>What does this mean for you? Unless you&#8217;ve got the deep pockets to fight in court with the trademark owner, you may want to make the decision to avoid using the marks in your pay-per-click (PPC) campaigns. Even if you&#8217;re legally right (and that&#8217;s not a sure bet), you can still be ruined in a lawsuit that eats up your time and money.</p>
<p>Then again, you could be one of the lucky ones who uses the keywords and doesn&#8217;t hear a peep from the trademark owners. Kind of like playing Russian Roulette. Do you feel lucky?</p>

If someone owns the trademark, service  mark, or registered trademark, you may infringe upon that mark by using a  similar word or phrase as your site&#8217;s domain name. 			<content:encoded><![CDATA[<p>A license agreement is a contract in which one party grants another party permission to do something that would otherwise be illegal. These types of licenses are common for intellectual property protected by copyright, patent, or trademark. It can include a proprietary way of doing business, such as real estate investing or even operating a yoga studio.</p>
<p>Licensing agreements are more flexible than franchises because they are not heavily regulated by the government, are more flexible, and are less expensive to create and control than a franchise. Licenses promote entrepreneurs instead of suffocating them with a one-size-fits-all method of doing business one finds with franchises.</p>
<p>There are two primary ways to grow your business through licensing: (1) find others who are willing to pay licensing fees for what you own and make money by replicating your business through these licensees; and (2) become a licensee for the rights to something that would be profitable for your business to use.</p>
<p>If you&#8217;ve invented the wheel, license it and make money. If you haven&#8217;t, don&#8217;t reinvent it. License it from the inventor.</p>

It harkens back to the day when             Utah&#8217;s WordPerfect was the most popular word processor and Novell             was still headquartered in Orem.</p>
<p align="left" style="line-height: 100%" class="MsoNormal style34">No             longer on the cutting edge, the state now attempts to make itself             relevant for something other than HBO&#8217;s <a href="http://www.hbo.com/biglove/"target="_blank"  onclick="javascript:urchinTracker ('/outbound/article/www.hbo.com');">Big             Love</a>.</p>
<p align="left" style="line-height: 100%" class="MsoNormal style34">Utah&#8217;s             legislature has just passed a law that attempts to restrict the way             you do business on the Internet. Called the &#8220;<a href="http://le.utah.gov/%7E2007/bills/sbillamd/sb0236.htm"target="_blank"  onclick="javascript:urchinTracker ('/outbound/article/le.utah.gov');">Trademark             Protection Act</a>,&#8221; this poorly written legislation creates an             &#8220;electronic registration mark.&#8221;</p>
<p align="left" style="line-height: 100%" class="MsoNormal style34">How             can this affect you?</p>
<p align="left" style="line-height: 100%" class="MsoNormal style34">The             law might be violated if you use as an advertising keyword (such as             in Google Adwords or other pay-per-click (PPC) campaigns) a mark             that has been registered in Utah under the new law.</p>
<p align="left" style="line-height: 100%" class="MsoNormal style34">Imagine             the chaos if all 50 states set up such laws and you had to pay             annual registration fees in each to protect your mark.</p>
<p align="left" style="line-height: 100%" class="MsoNormal style34">Look             for this bill to be struck down as unconstitutional. The state is             interfering with interstate commerce. In the mean time, tread             carefully when doing business in Utah.</p>

<p align="left" class="MsoNormal style34" style="line-height: 100%">This             scam preys on small business owners looking to protect an invention.             The so-called &#8220;promotion company&#8221; will charge a hefty fee to             &#8220;evaluate&#8221; the invention. The results of the evaluation             pretty much hinge on the ability to pay, i.e. if you pay the fee,             the company will say that your invention is wonderful with plenty             of potential.</p>
<p align="left" class="MsoNormal style34" style="line-height: 100%">Of             course, this leads to additional scams. One variation is to charge a             large amount of money to get legal protection (patent, copyright,             trademark, etc.). Or you could be offered a bogus marketing plan             that will take more money from your wallet. If you happen to have a             truly worthwhile invention, expect the company to push you to sign             over your rights to it for little or no money.</p>
<p align="left" class="MsoNormal style34" style="line-height: 100%">This             week, the U.S. Federal Trade Commission (FTC) filed a civil contempt action against four people and             eight businesses for alleged deceptive trade practices that include             some of the misconduct that I&#8217;ve described here.</p>
<p align="left" class="MsoNormal style34" style="line-height: 100%">What             this means is that the defendants were already nailed in court but             continued to operate.</p>
<p align="left" class="MsoNormal style34" style="line-height: 100%">If             you&#8217;ve got an invention or other intellectual property to protect,             use a reputable business attorney if you don&#8217;t know how to do the             work yourself.</p>
