Some Texas taekwondo dojangs break state law because they’re not complying with the Texas Health Spa Act.
Now if your Texas dojang gets caught, it could destroy everything. For example, every membership contract that violates this statute is void. This means all your students can walk away at any time because the membership agreements aren’t enforceable.
If you get sued for violating the Health Spa Act, you risk the following:
(1) actual damages;
(2) equitable relief;
(3) punitive damages; and/or
(4) reasonable attorney’s fees and court costs.
In addition, the Texas Attorney General can come after you for running an illegal operation and you could be on the receiving end of a court injunction preventing you from running your dojang and fines of up to $25,000.
On top of that, there are also criminal charges in some cases.
