Although it may not sound applicable, the Texas Health Spa Act does cover most gyms and dojos in the Lone Star State. This law is designed to protect members from getting screwed financially by membership contracts.
What happens if you violate the law? There are a number of horrible consequences. For example, all of your membership agreements could be void, which means your members can simply stop paying and walk away.
And here’s a typical example of how the state handles violations. Flex Fit Gyms was shut down by the state’s Attorney General and the owner had to pay a fine plus attorneys’ fees.
